RENTAL AGREEMENT & BOOKING TERMS
By making a reservation, submitting payment, and/or accepting mobility equipment from Cruise Comfort Mobility LLC (“Cruise Comfort Mobility”), the renter agrees to the following Rental Agreement and Booking Terms.
1. RESERVATIONS AND PAYMENT
A 25% payment is required at the time of booking to reserve the mobility scooter for the requested rental period.
The remaining 75% balance is due 7 days before the scheduled rental start date.
Reservations made within 7 days of the rental start date require 100% payment at the time of booking.
A reservation is not guaranteed until the required payment has been successfully received and the reservation has been confirmed by Cruise Comfort Mobility.
2. IDENTIFICATION REQUIREMENT
The person responsible for the rental must be at least 18 years old and must provide a valid government-issued photo ID upon request.
The person making the reservation is responsible for the rented equipment and for complying with the terms of this agreement.
3.SECURITY DEPOSIT AND CARD AUTHORIZATION POLICY
For rentals of five (5) days or less, Cruise Comfort Mobility does not collect a security deposit. Instead, a temporary $300 credit card authorization hold per scooter will be required shortly before delivery. The authorization temporarily reserves available funds or credit but is not an actual charge to the customer’s account. Provided no additional charges are due under this Rental Agreement, the authorization will be released after the rental is completed. The timing for the available funds or credit to reappear is determined by the customer’s bank or card issuer.
For rentals of six (6) days or longer, a refundable $300 security deposit per scooter is required before delivery. Following return of the scooter, Cruise Comfort Mobility may inspect the equipment for damage, loss, missing accessories, excessive cleaning, or other charges permitted under this Rental Agreement. If no such charges apply, the security deposit will be refunded. If charges are applicable, Cruise Comfort Mobility may deduct the permitted amount from the security deposit and refund any remaining balance.
4. DELIVERY, PICKUP AND RETURN
Cruise Comfort Mobility will coordinate delivery and/or pickup of the rental equipment according to the arrangements associated with the reservation.
The renter is responsible for providing accurate information, including cruise ship, cruise dates, arrival and departure information, and current contact information.
Equipment must be returned at the agreed-upon date, time, and location.
The renter may be responsible for reasonable additional charges resulting from a late return, failure to return the equipment as agreed, or expenses reasonably incurred by Cruise Comfort Mobility to recover unreturned equipment.
5. PROPER USE AND CARE OF EQUIPMENT
The renter agrees to use the mobility scooter safely, responsibly, and only for its intended purpose.
The renter agrees to:
- Follow all operating and safety instructions provided by Cruise Comfort Mobility or the equipment manufacturer.
- Observe the scooter's stated weight capacity.
- Keep the scooter reasonably protected from excessive water, misuse, abuse, or preventable damage.
- Properly charge the scooter as instructed during the rental period.
- Not modify, dismantle, or attempt unauthorized repairs to the equipment.
- Not allow the scooter to be used in an unsafe or reckless manner.
- Promptly notify Cruise Comfort Mobility if the scooter is damaged, lost, stolen, or experiences a mechanical problem.
6. DAMAGE, LOSS AND THEFT
The renter is responsible for the rental equipment from the time it is received until it is returned to and accepted by Cruise Comfort Mobility.
The renter will not be charged for normal wear and tear or for mechanical failure that was not caused by misuse, negligence, accident, improper handling, or failure to follow operating instructions.
The renter may be financially responsible for damage beyond normal wear and tear, loss, theft, missing accessories or components, or damage resulting from misuse or negligence.
If the scooter is lost, stolen, or damaged beyond reasonable repair, the renter may be responsible for the reasonable repair or replacement cost, even when that amount exceeds the $300 card authorization hold.
7. CANCELLATIONS AND REFUNDS
Cancellations made 14 or more days before the scheduled rental start date will receive a refund of amounts paid, less any clearly disclosed non-refundable fees, if applicable.
Cancellations made 7–13 days before the scheduled rental start date will receive a 50% refund of amounts paid.
Cancellations made less than 7 days before the scheduled rental start date, including no-shows, are non-refundable.
If Cruise Comfort Mobility is unable to provide the reserved equipment and cannot provide a suitable replacement, the customer will receive a refund of the affected rental charges.
8. CRUISE ITINERARY CHANGES
Cruise schedules, port assignments, weather conditions, delays, cancellations, and cruise-line operations are outside the control of Cruise Comfort Mobility.
Customers should notify Cruise Comfort Mobility as soon as possible if their cruise itinerary changes.
Cruise Comfort Mobility will make reasonable efforts to accommodate itinerary changes when possible; however, availability and alternative arrangements cannot be guaranteed.
9. MECHANICAL PROBLEMS
If a renter experiences a problem with the scooter, the renter should contact Cruise Comfort Mobility as soon as reasonably possible.
Cruise Comfort Mobility will make reasonable efforts to troubleshoot the problem or provide assistance or replacement equipment when reasonably available.
Cruise Comfort Mobility is not responsible for problems resulting from misuse, failure to properly charge the equipment, exceeding weight limits, unauthorized repairs, accidents, or failure to follow operating instructions.
10. ASSUMPTION OF RESPONSIBILITY AND SAFE OPERATION
The renter acknowledges that operating mobility equipment involves inherent risks, including falls, collisions, tipping, property damage, and personal injury.
The renter agrees to operate the equipment responsibly, exercise reasonable care, and follow applicable cruise-line, terminal, property, and safety requirements.
To the extent permitted by applicable law, Cruise Comfort Mobility is not responsible for injuries, losses, or damages resulting from misuse, reckless operation, failure to follow instructions, or use of the equipment in a manner for which it was not intended.
Nothing in this agreement is intended to waive or limit any rights or responsibilities that cannot legally be waived or limited under applicable law.
11. ACCEPTANCE OF AGREEMENT
By completing a reservation, submitting payment, and/or accepting rental equipment, the renter acknowledges that they have read, understood, and agreed to these Rental Agreement and Booking Terms.
